Maybe in the back of your mind you know that you should have a written Last Will and Testament in place. Perhaps you see a tragic news story about the death of a parent with young kids and you think about what would happen to your own kids in that situation. But then, days and weeks get away from you and this task on a long to-do list never gets done.  If this sounds familiar, let me encourage you to move the drafting of your will up ahead of cleaning out your closets, trimming the hedges or a whole host of other tasks that fight for our free time. And as a licensed Texas attorney in the legal areas of wills, trusts and estates, I will share a few reasons why.

You’re a single parent with full custody or conservatorship of your child. If something happens to you and your desired guardianship is not spelled out, does the child’s other parent, who has made little effort to be in his life before now, get custody?  If you own a home, do you want that property to be sold upon your death?  Have there been plans discussed for a child or grandchild to live in that home after your death. If this plan isn’t known to the entire family, that move-in date might never happen.  Or, do you have advanced medical directives on file with your medical doctor?

You have a heart attack while running at the gym. It’s not pleasant to think about, but it happens. Would your wife know how to access your life insurance papers and your retirement account? Ocean Tourists Can Have Serious Injuries Parasailing News 586

According to ABC News, there have been 33 serious parasailing accidents in the state of Florida between 1998 and today.  Six of those accidents caused fatalities.

Unfortunately, the parasailing industry is largely unregulated, which contributes to the risk of accidents occurring. Many of these accidents involve tourists who visit Florida and who try out parasailing on their vacation, including one recent devastating accident that injured two visiting girls.

Parasailing Accident Seriously Injures Tourists

According to WPTV, two 17-year-old girls recently went parasailing while on vacation in Florida.

Unfortunately, the line on the parasail broke when the girls were out on the water. As a result, the young girls slammed hard into the side of a nearby condo building and hit a power line and a car in a parking lot.  The girls were seriously injured as a result of their ordeal, with one suffering from back injuries necessitating surgery and the other suffering neck injuries.

One of the two girls has been walking with assistance despite her injuries, while the other is able to communicate only through nods, blinks and small hand gestures. While there is hope that both girls will make a recovery, there is a long road to go for the young women and their families.

According to the Louisiana Record, a recycling company is being sued by two Louisiana men who were injured on its premises. The men were harmed by a crane that was being used to try to remove scrap metal from a trailer. Lawyers in Louisiana know that when a company provides a service to the public and opens its doors to do business, the company has an obligation to ensure the safety of patrons.  In this case, it will be important to determine if the company fell short in its obligation in a way that led to the crane accident and resulting injuries.

What is the Recycling Company’s Responsibility?

The Louisiana Record reports that the two men injured at the recycling company were hurt as a result of a crane attached to a trailer belonging to one of the men. The crane was attached to help remove scrap metal when it got stuck and allegedly lifted. The trailer was shaken by the crane and hit the rear of one of the men’s trucks. Both of the men were reportedly injured as a result of the impact.

The two men filed a lawsuit in the Central District Court and the defendant recycling company has been accused of failing to properly train its employs, improperly entrusting a crane to its employees, and operating a business with unsafe practices and unsafe operations.
